Terms of Service

These Terms govern your use of the Oops I'm Late! mobile application (the "App") published by Alex Reich. By installing or using the App you agree to these Terms. If you don't agree, don't use the App.

1. The service

The App helps you notify recipients when you are running late to a calendar appointment. It uses your device's calendar, GPS, and contacts — and, if you subscribe to a paid tier, an off-device traffic ETA proxy.

The App does not require an account today. Anonymous install identifiers are used for proxy authentication and entitlement lookup. If we add accounts in the future, additional terms will apply at sign-up.

Use of the App is governed by our Privacy Policy, which is incorporated by reference.

7. Disclaimers

The App is provided "as is" without warranty of any kind. We do not guarantee that notifications will be delivered on time, that ETA estimates will be accurate, or that the service will be uninterrupted. We don't accept responsibility for outcomes resulting from late notifications, missed appointments, GPS inaccuracy, or carrier-side SMS delivery issues.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from your use of the App is limited to the amount you paid us in the twelve months preceding the claim. We exclude liability for indirect, incidental, consequential, special, or punitive damages.

9. Changes to these Terms

We may update these Terms. Material changes will be surfaced in-app on next launch and the "Effective date" updated. Continued use after a change means you accept it.

10. Termination

You can stop using the App at any time. We may suspend or terminate access if you breach these Terms or attempt to interfere with the service.

11. Governing law

These Terms are governed by the laws of California, USA, excluding conflict-of-laws rules. Disputes will be resolved in the state or federal courts in Los Angeles County, California, subject to any rights you have under applicable consumer protection law.
